1. Introduction

1.1 Your privacy is important to us. We are committed to protecting your privacy and responsible management of the information provided by you in connection with your use and access of the Site and Services.

1.2 This Policy describes how data provided by or collected from you may be used, managed, disclosed, shared or removed. 2. Definitions

Unless otherwise defined below or in this Policy, the terms used herein shall have the same meanings as those defined in the Terms of Use which can be found on www.lexmatch.co:

(a) “Personal Data” means data that allows an individual to be contacted or identified from such data, such as your name, home address, phone number, email address, identification number;

(b) “Anonymous Data” means data that is not associated with or linked to your Personal Data and does not by itself allow an individual to be identified from such data; and

(c) “Data” means Personal Data and/or Anonymous Data.

3. Collection of Data

3.1 We collect Data from information that you voluntarily provide to us through your use and access of the Site and Services, including but not limited to when (a) you register as a Candidate or Employer, (b) you input, send or upload information or files to us, (c) you create a profile as a Candidate or Employer, (d) you sign up for marketing emails or events, (e) you apply for a job as a Candidate and (e) you post a job as an Employer.

3.2 Data that you provide through your use and access of the Site and Services may include your Personal Data or other information including but not limited to:

(a) your name, address, phone number, email address, gender, nationality, career history, education history, extracurricular achievements, username and password when you register or update a Candidate profile or apply for a job;

(b) your contact details, organization structure, key personnel, business partners, compensation and benefits, training and development, culture, bank and billing details when you register or update an Employer profile or post a job; or

(c) information within your resume or supporting documents when you provide these to us;

3.3 Our Site and servers (which may be hosted by a third party service provider) may collect Data relating to your use of the Site including your browser, operating system, internet protocol address, unique device identification number, geographic location, date/time stamp of your visit and other technical data collected through cookies, pixel tags or other similar technologies.

3.4 If you participate in any referral or invitation program to invite third parties to join or use the Site or Services, we will collect and use the third party’s name, email address and phone number in order to contact and follow up with the third party and include it as part of our referral database and network of contacts. We may also use this Data to show you and other users that you may know each other or have shared contacts. We rely upon your reasonable exercise of good faith and discretion in not providing Data of and connecting us with third parties who you are aware or believe will not agree or be willing to be contacted or have their Data received by us.

3.5 We may receive Data about you from other sources, companies or persons, which include parties who are involved in provision of the Services (whether via a co-branded, private-labelled or independent website or business), parties with whom such Data is transferred in accordance with applicable privacy and data protection laws, or Data about you that is obtained from publicly available sources.

4. Use of Data

4.1 We may use the Data collected for a number of purposes including but not limited to:

(a) identify you as a user and member of our Site and Services;

(b) facilitate the creation, verification, completion and updating of your user account;

(c) create and display a user profile that will be publicly available and accessible by other Candidates and Employers through third party sites, services and search engines;

(d) continuously monitor and improve the security, administration, speed, accuracy, quality and user interaction and experience of the Site and Services;

(e) provide the Services to you (including but not limited to (i) assess and match Candidates against available jobs, (ii) produce extracts or summaries of a Candidate, Employer or job, (iii) shortlist and send suitable Candidates to an Employer, (iv) shortlist and send suitable jobs to a Candidate, (v) sending alerts relating to job posts, applications, interviews, offers and rejections, and (vi) process payments and transactions);

(f) send you notifications relating to changes in the terms and conditions, policies, security, support or other administrative matters relating to your use of the Site and Services;

(g) send news updates or marketing and other promotional materials related to the Site or Services;

(h) respond to your inquiries, requests or feedback; or

(i) contact you to receive feedback and recommendations in our efforts to continuously improve our offerings to you.

4.2 For Data that will be displayed in your public profile, you agree and acknowledge that such information will be publicly viewable, searchable and accessible and may be collected and used by other users or third parties. We cannot control who reads your public profile or posts or what other users may do with the Data. While you may still be able to edit and delete such Data from our Site, you will not be able to edit or delete such information cached, collected, and stored elsewhere by other sites or search engines.

4.3 We may create Anonymous Data records from the Data received by excluding and anonymizing Personal Data that allows an individual to be personally identifiable. Anonymous Data may be used and analysed for usage patterns, advertising purposes, consolidation into graphs or charts, employability screening and matching and for general application towards improving the content, user interface and user experience of our Site and Services. We reserve the right to use Anonymous Data for any purpose and to present and share Anonymous Data to third parties at our sole discretion.

4.4 You will have the option to opt-out or unsubscribe from receiving calls, emails or marketing and promotional materials from us by following the unsubscribe instructions provided in the email, changing your user settings or informing us at hello@lexmatch.co, provided that you will continue to receive service or account-related communications (such as updates to our Term of Use or this Policy).

4.5 If do not wish to accept cookies from our Site or Services, you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, in such a case you may not be able to use all portions of the Site or all functionalities of the Services.

5. Retention of Data

We will retain Data collected where we have a justifiable business need to do so which will be exercised at our discretion, unless a longer period is required by applicable laws.

6. Disclosure and Transmission of Data

6.1 When you use the Site and Services, you may designate third parties or other users who will be entitled to receive your Data (including your Personal Data) through your user settings or through actions taken which can reasonably be taken to constitute your consent to disclosure, including but not limited to:

(a) directly submitting or expressly consenting to us submitting on your behalf a job application as a Candidate to an Employer, which will be deemed to constitute your consent for the Employer to receive an indication of your express interest in the job opportunity and access the Data (including Personal Data) contained in your job application;

(b) creating a Candidate profile or submitting your resume, which will be deemed to constitute consent from you to us to assess and match you against available job opportunities and contact you to understand your interest in submitting an application for a suitable job opportunity; and

(c) creating a Candidate profile or submitting your resume, which will be deemed to constitute consent from you to us to extract or convert your Data into a summary sheet (which may include some Personal Data) which may be viewed and assessed by other users such as Employers who may then separately contact you to understand your interest in submitting a job application. For the avoidance of doubt, we will never represent that you are interested in a job opportunity unless you have consented to us doing so.

6.2 We may share your Personal Data with group companies, third party service providers or vendors who are involved or form part of the Site or Services provided to you. This includes but is not limited to third parties providing support in billing, payment processing, accounting, quality and systems testing, marketing and branding, customer relationship management, data analytics and other types of technical, IT and administrative support. Where Data is disclosed to any such third party, we cannot control and provide no guarantees or indemnification against the use and storage practices of the third parties. Our business partners are responsible for ensuring their own compliance with applicable laws. Nevertheless, we will act in good faith when engaging business partners and will promptly follow up with any requests or alerts from users regarding their Data.

6.3 We may share Data in connection with or during negotiation of any merger, financing, acquisition, sale, transfer or dissolution of our business, assets or company(ies). In the event of a sale, insolvency, bankruptcy, receivership or other similar transaction, the Data may be regarded as a business asset to be transferred to the new owner or dealt with accordingly in accordance with the applicable laws.

6.4 Notwithstanding anything stated by us or elected by you, we may disclose any Data if we believe in good faith that such disclosure is reasonably necessary in connection with any legal investigation by a government authority or court, compliance with applicable laws or a subpoena or warrant served on us, or the protection or defence of our company, business or rights whether or not arising from a violation of our terms and conditions.

7. Third Party Websites

7.1 Our Site may contain links to third party websites or service providers. The links to such third party websites or locations are for your convenience only and do not signify our recommendation of the quality, safety or security of such third parties or their content, products or services.

7.2 When you click on a link to any other website or location, you will leave our Site and another entity may collect Data from you. We have no control over and are not responsible for these outside websites or their content. The terms of this Policy do not apply to your use of these third party websites and we encourage you to read the terms and policies of these websites separately before use.

8. Security of Data

8.1 We are committed to protecting the security of your Data. We use a variety of industry-standard security technologies and procedures to help protect your Data from unauthorized access, use, or disclosure.

8.2 Notwithstanding the above, we are unable to guarantee that the organizational or technical measures are 100% secure. Please exercise your discretion when submitting or disclosing information online and act reasonably to protect yourself. 8.3 We require you to enter a password to access your account and take material actions relating to your status as a Candidate and Employer (such as a job post and job application). Please do not disclose your account password to others.

9. Changing or Deleting your Personal Data

9.1 You may modify your account details and user profile or opt-out or unsubscribe from receiving calls, emails or marketing and promotional materials at any time through your user account and dashboard or by informing us at hello@lexmatch.co.

9.2 If you have any questions or concerns relating to your right to withdraw consent, access, erase or object to any processing of your Personal Data, please contact us at hello@lexmatch.co. We will consider and adhere to your request as required by applicable laws.

10. Changes to Policy

10.1 This Policy may be updated from time to time by us in response to changing legal, technical and business developments. If any material changes are made to the Policy, we shall notify you through our Services or by other means (including via email or a post or publication on our Site). We advise you to read the Policy periodically to stay updated on how we are protecting your Personal Data.

10.2 If you object to any changes, you may opt to close your account and cease further use and access of our Site and Services. You acknowledge that any continued use or access of our Site and Services after a publication or delivery of notice to you after the changes will be deemed to be you consenting and agreeing to the amended Policy as applicable to you.
